Who we are
TurningAuto is a marketplace operated by Turning, a company registered in Delaware, United States ("TurningAuto", "we", "us"). We connect people selling cars with people buying them. We are not the seller of any car listed by a member, and we don't take ownership of the cars sold here.
Your account
One account lets you buy, sell and run bidding agents. To open one you must be at least 18, able to enter binding contracts, and give us accurate details. You can sign in with email and password or with a provider such as Google.
You are responsible for everything done through your account, including bids placed by your agents. Keep your sign in details private and tell us at once if you think someone else has used your account.
We may suspend or close an account that breaks these terms, puts other members at risk, or fails to pay for a car it won. A suspension takes effect immediately and pauses the account's agents. Bids already placed stand.
Listing a car
Listing is free. When you list a car you confirm that:
- you own it, or are authorised to sell it, and can transfer clear title;
- the description, mileage and condition are accurate, and you disclose known faults, accident history and outstanding finance;
- the photos are real, recent photos of that exact car. Every listing needs at least four: front, back, side and interior. We don't accept generated or stock images.
Every listing is reviewed before it goes live. We may approve it, send it back with a reason, or take it down later if it breaks these terms. An auction starts its full running time from approval.
A fixed price listing is an offer to sell at that price to the first member who accepts it. An auction listing is an offer to sell to the highest bidder at or above your reserve. You can withdraw a listing before it sells, but not an auction that has already received bids.
Buying and bidding
Pressing Buy on a fixed price car, or placing a bid, is a binding offer. If you buy outright, or hold the highest bid at or above the reserve when an auction closes, you have entered a contract to buy that car.
A bid placed in the final two minutes of an auction extends its close by two minutes, so every bidder has a fair chance to answer. Reserves are hidden. If bidding doesn't reach the reserve, the car doesn't sell and no one is charged.
You can't bid on or buy your own listings, and you must not bid to raise the price of a car you are selling or have an interest in.
Bidding agents
A bidding agent places bids for you, following the instructions you give it: the cars to look for, the most to pay per car, the step to raise by, and how many cars to win. By turning an agent on, you authorise every bid it places within those instructions, and those bids bind you exactly as if you placed them yourself.
An agent never bids above your maximum and never holds more leading bids than the cars it still has to win. It stops once it has won the number of cars you set. You can pause or delete an agent at any time; bids it already placed stand.
Agents depend on our systems working. We don't promise an agent will win any particular car, and we aren't liable for a bid an agent didn't place because of an outage or delay.
Payments, fees and escrow
Buyer's fee. When you win or buy a car you pay the price plus our buyer's fee: 5% of the final price, in the car's currency: at least $250 and at most $5,000 for cars priced in US dollars, or at least ₦350,000 and at most ₦7,000,000 for cars priced in naira. The fee is shown before you bid or buy. Sellers pay nothing to list and receive the full price.
Paying. You must pay the full amount within 72 hours of the sale, through TurningAuto. Never pay a seller directly. If you don't pay in time we may cancel the sale, suspend your account and offer the car to others.
Escrow. We (or our payment partner) hold the buyer's payment until the buyer confirms in their garage that they have received the car. We then release the price to the seller. If a buyer doesn't confirm or raise a problem within 7 days of handover, we may release the funds.
Refunds. If a car isn't delivered, or is materially different from its listing, tell us before confirming delivery. We may refund the buyer in full, including the fee, after reviewing the evidence from both sides. Our decision on releasing or refunding held funds is final as between you and us, without limiting any rights you have under law.
Card payments are processed by a regulated payment provider. We never see or store your full card number.
Handover, title and inspection
Buyer and seller arrange collection or delivery between themselves once the buyer has paid. We share each party's name and contact details for that purpose only.
The seller must hand over the car, its keys, title and documents in the condition described. The buyer is responsible for registration, taxes and insurance from handover. We recommend an independent inspection before you bid on any car; partner inspections may be offered for a fee.
What you must not do
- Bid on your own car, or arrange for others to, to raise its price.
- Arrange to complete a sale outside TurningAuto to avoid fees.
- List a car you can't sell, misdescribe one, or use photos that aren't of it.
- Interfere with auctions, agents or our systems, or collect data from the site by automated means.
- Harass other members or use the site for anything unlawful.
Your content
You keep ownership of the photos and text you upload. You give us a worldwide, royalty free licence to host, display and adapt them (for example resizing photos) to run and promote the marketplace, for as long as they are on the site and a reasonable time after. We remove location data from photos when you upload them.
Disputes between members
The contract for each car is between its buyer and seller. If something goes wrong, contact us first: we'll help, and while funds are held we decide whether to release or refund them as described above. We aren't a party to the sale contract and don't guarantee any member's performance.
Disclaimers and liability
We review listings for completeness and obvious problems, but we don't inspect cars and don't guarantee their condition, history or title. The site is provided as is.
To the extent the law allows, we aren't liable for indirect or consequential loss, and our total liability to you for any claim is limited to the fees you paid us in the 12 months before it. Nothing in these terms limits liability that can't be limited by law, such as for fraud.
You agree to cover our reasonable losses arising from your breach of these terms or of the law.
Changes and ending
We may update these terms. If a change matters, we'll tell you by email or on the site before it takes effect; continuing to use TurningAuto afterwards means you accept it. You can close your account at any time, once any open sale or order is completed.
Law and contact
These terms are governed by the laws of the State of Delaware, and disputes go to its courts, unless the law where you live gives you the right to bring them locally. Contact us at legal@turningauto.app. See also our privacy policy.
